By booking simulator time, purchasing a membership, or entering Eagles Nest Golf Lounge, LLC (“Eagles Nest,” “the Facility,” “we,” “us”), you acknowledge that you have read, understand, and agree to all terms set forth below.

1. ACCESS & USE OF FACILITY
• Eagles Nest Golf Lounge, LLC is a members-only indoor golf facility, with limited public hourly bookings during designated hours.
• 24/7 access is available only to eligible members.
• Access credentials are issued to individuals and may not be shared.
• Any violation of access rules may result in suspension or termination without refund.

2. MEMBERSHIPS & BILLING
• Membership fees are billed monthly and are non-refundable.
• Simulator hours reset monthly and do not roll over, unless explicitly stated.
• Founding Membership pricing is locked for life only while the membership remains active and in good standing.
• Eagles Nest Golf Lounge, LLC reserves the right to enforce fair-use policies to ensure equitable access for all members.

3. BOOKINGS & TIME USE
• Simulator time must be booked in advance.
• Booking priority is determined by membership tier.
• Late arrivals do not extend reserved booking time.
• Eagles Nest Golf Lounge, LLC may limit bookings during peak hours, maintenance, or special events.

4. GUESTS
• Members are fully responsible for the conduct and actions of their guests.
• Guests must comply with all facility rules and safety guidelines.
• All guests must agree to this agreement prior to participation.

5. BYOB POLICY
• BYOB is permitted only for Founding and VIP members.
• No glass containers are allowed.
• Excessive intoxication, unsafe behavior, or violations of local or state law will result in immediate removal and possible membership termination.
• BYOB is not permitted for Base Memberships, Family Memberships, or public hourly bookings.

6. CONDUCT & SAFETY
• Proper golf etiquette and safe swinging practices are required at all times.
• Reckless behavior, horseplay, or misuse of equipment is prohibited.
• Eagles Nest Golf Lounge, LLC reserves the right to refuse service or remove any individual for safety or rule violations.

7. ASSUMPTION OF RISK
Participation in golf simulator activities involves inherent risks, including but not limited to:
• Being struck by golf balls or clubs
• Equipment malfunction
• Slips, falls, or other physical injuries
You voluntarily assume all risks, whether known or unknown, associated with participation.

8. LIABILITY WAIVER & RELEASE
To the fullest extent permitted by Texas law, you hereby release, waive, and discharge Eagles Nest Golf Lounge, LLC, its owners, members, managers, employees, contractors, and affiliates from any and all claims, demands, injuries, losses, or damages arising from use of the facility, including those caused by negligence.
You assume full responsibility for your participation and any resulting injury, loss, or damage.

9. MEDICAL RESPONSIBILITY
You certify that you are physically capable of participating in simulator activities and assume responsibility for any medical treatment or expenses incurred.

10. MINORS
Participants under the age of 18 must have a parent or legal guardian accept this agreement on their behalf prior to participation.

11. DAMAGE & FINANCIAL RESPONSIBILITY
You accept full financial responsibility for any damage caused by you or your guests to Eagles Nest Golf Lounge, LLC property, including but not limited to:
• Golf simulators, impact screens, projectors, and computers
• Mats, clubs, balls, furniture, TVs, walls, flooring, or fixtures
Eagles Nest Golf Lounge, LLC reserves the right to assess damage and determine repair or replacement costs.

12. AUTHORIZATION TO CHARGE
You authorize Eagles Nest Golf Lounge, LLC to charge the payment method on file for repair or replacement costs resulting from damage caused by negligence, misuse, or violation of facility rules.
Failure to pay for damages may result in:
• Immediate suspension or termination of membership
• Denial of future bookings
• Legal or collection action if necessary

By completing a booking or membership purchase, you confirm that:
• You have read and understand this agreement
• You voluntarily agree to all terms
• This agreement is binding upon you, your heirs, executors, and assigns
